These Terms are an agreement between you and Trevor Ringle ("we," "us") for the Upward app. By downloading or using the app, you agree to them.
Upward helps you train toward a push-up goal with a camera-based rep counter and an adaptive training plan. A free tier provides the counter; a paid subscription unlocks the coaching plan, progress features, game modes, and share cards.
Eligibility. You must be at least 13 years old (or the minimum age of digital consent in your region) to use the app. If you are under 18, you may use the app only with the consent of a parent or guardian who agrees to these Terms.
Rep counts and form assessments are automated estimates produced by on-device computer vision. They can be affected by lighting, camera placement, clothing, and movement, and may be imperfect. They are provided for guidance only.
Coaching is offered as an auto-renewable subscription in these plans:
A 7-day free trial is available to new subscribers on the annual plan. Prices are in U.S. dollars, may vary by region, and may change; any change will apply only to future billing periods.
Billing and auto-renewal. Payment is charged to your Apple ID account at confirmation of purchase. Your subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period. Any unused portion of a free trial is forfeited when you purchase a subscription. You can manage or cancel your subscription in your App Store account settings. Purchases are processed by Apple and are subject to Apple's terms; refunds are handled by Apple in accordance with its policies and applicable law.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices you own or control, for your personal, non-commercial use, subject to these Terms and to Apple's Licensed Application End User License Agreement, which also applies to your use of the app.
Apple. These Terms are between you and Trevor Ringle only, not Apple. Apple has no obligation to furnish maintenance or support for the app and is not responsible for the app or any claims relating to it — including product liability, any failure to conform to legal or regulatory requirements, and claims under consumer-protection or intellectual-property law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Don't reverse engineer, resell, or misuse the app, and don't use it in any unlawful way or in a way that infringes others' rights. We may suspend or terminate your access to the app if you violate these Terms; sections 6–9 and 11 survive any termination.
The app, its design, and its content are owned by us and our licensors and are protected by law. These Terms grant you no ownership rights.
The app is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or accurate.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of — or inability to use — the app, including any injury related to exercise. Our total liability for any claim will not exceed the amount you paid for the app in the twelve months before the claim.
You agree to indemnify and hold us harmless from claims arising out of your misuse of the app or violation of these Terms.
We may update these Terms as the app evolves. Continued use after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Nothing here limits Apple's separate terms that apply to your purchase. If any provision of these Terms is found unenforceable, the remaining provisions stay in full effect. These Terms, together with the Apple EULA referenced above and our Privacy Policy, are the entire agreement between you and us regarding the app.
